1. Scope

These Terms of Service (hereinafter «ToS») apply to the use of the platform DiasporaNow.ch and all associated domains. By using the platform, you agree to these ToS.

2. Platform Description

DiasporaNow.ch is a marketplace/directory platform that connects users with providers of services, products, housing, jobs, and other offerings.

3. Registration and User Account

• Registration is voluntary. Without an account, you can browse the platform and view contact details.
• Registration is required to publish listings.
• You are required to provide truthful information.
• You are responsible for the security of your account.
• Multiple accounts are not permitted.

4. Listings and User-Generated Content

4.1 Permitted Content

Users may publish listings in the designated categories. Listings must:

• Be truthful and not misleading
• Comply with applicable law (Swiss law and, where applicable, EU law)
• Not infringe third-party rights (copyright, trademark, personality rights)
• Be free of discriminatory, offensive, or unlawful content

4.2 Prohibited Content

The following content is prohibited on the platform:

• Illegal goods or services
• Counterfeit products or fraudulent offers
• Hate speech, discrimination, incitement to violence
• Spam, chain-letter-like content, unsolicited advertising
• Pornographic or youth-endangering content
• Personal data of third parties without their consent

4.3 Ownership Rights

You retain ownership of your content. By publishing, you grant DiasporaNow.ch a non-exclusive, royalty-free license to display and distribute your content on the platform.

5. User Obligations

• You use the platform at your own risk and responsibility.
• You independently verify the legitimacy of providers and offers.
• You bear full responsibility for concluded transactions and agreements.
• You report suspicious or unlawful content via the reporting function.

6. Disclaimer of Liability

DiasporaNow.ch assumes no liability for:

• The accuracy, completeness, or timeliness of user content and listings
• The quality, safety, or legality of offered goods or services
• The ability of providers to deliver their services
• The solvency of buyers
• Damages arising from the use of the platform or from transactions between users
• The availability or technical accuracy of the platform

DiasporaNow.ch is in no case liable for indirect damages, consequential damages, or lost profits.

7. Moderation and Removal

DiasporaNow.ch reserves the right to:

• Remove listings and content without notice that violate these ToS
• Suspend or delete user accounts for repeated violations
• Review reported content within 24 hours

8. Paid Services

Basic features (browsing, contacting, basic listings) are free. Premium features (highlighted listings, business subscriptions) may be paid. Prices are transparently displayed before booking. Payment processing is handled by Stripe.

9. Data Protection

The protection of your personal data is important to us. Details about data processing can be found in our Privacy Policy.

10. Applicable Law and Jurisdiction

Swiss law applies. The place of jurisdiction is the registered office of the operator in Switzerland. For EU consumers, the mandatory consumer protection provisions of their country of residence additionally apply.

11. Severability Clause

Should individual provisions of these ToS be invalid, the validity of the remaining provisions shall remain unaffected. The invalid provision shall be replaced by a valid one that comes closest to the economic purpose.

12. Changes to the ToS

DiasporaNow.ch may change these ToS at any time. Registered users will be informed of material changes by email. Continued use of the platform after the changes take effect constitutes acceptance.
